Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy is a separate policy required by the Washington My Health My Data Act and Nevada’s consumer health data law. It applies specifically to “consumer health data” and supplements our general Privacy Policy. It applies to residents of Washington and Nevada. We extend the same practices to all our customers.

1. Why This Policy Exists

ReposePoint LLC sells physical therapy, recovery, mobility, and wellness devices, including massagers, TENS units, ultrasound therapy machines, braces and supports, posture correctors, sleep and snoring aids, and hearing aids.

Washington and Nevada define “consumer health data” broadly. It includes not only information you tell us about your health, but also information that can be used to infer something about your physical condition, such as which health-related products you browse or purchase. Because of what we sell, some of the data we handle falls into this category. This policy explains what we do with it.

We are not a healthcare provider and we do not provide medical advice. Nothing on our Site is a diagnosis or a treatment recommendation.

2. What Consumer Health Data We Collect

  • Purchase history for health-related products, including which devices you buy, quantities, and repeat purchases.
  • Browsing activity on health-related pages, including which product and category pages you view, how long you spend, what you add to your cart, and which of our emails or ads you click.
  • Information you volunteer to us, such as a description of your pain, injury, symptoms, condition, or treatment goals shared in a customer support message, a product review, a return or warranty request, or a response to a survey. Reviews you post are published publicly on our Site and are handled by our reviews platform, WiserReview.
  • Inferences drawn from the above, such as an inference that you may be interested in products for a particular body area or type of discomfort.

We do not collect biometric data, precise geolocation data, genetic data, or diagnostic or clinical records.

3. Where This Data Comes From

  • Directly from you, when you place an order, contact support, leave a review, or subscribe to messages from us.
  • Automatically from your device, through cookies, pixels, analytics tools, and session recording technology used on our Site.
  • From our service providers, such as our email platform recording which messages you opened or clicked.

4. How We Use Consumer Health Data

  • To process, fulfill, and ship your order, and to handle returns, refunds, and warranty claims.
  • To respond to your customer support questions, including questions about whether a product suits your situation.
  • To send you emails and, if you separately opted in, text messages about products relevant to your interests, including abandoned-cart reminders.
  • To understand how visitors use our Site and to improve product pages and the shopping experience.
  • To measure the effectiveness of our advertising and, where advertising technologies are active, to show you advertising on other platforms.
  • To comply with legal obligations and to detect and prevent fraud.

5. Who We Share Consumer Health Data With

6. We Do Not Sell Consumer Health Data

We do not sell consumer health data in exchange for money, and we will not do so without first obtaining your separate written authorization as required by law.

We want to be clear about one thing: when advertising and analytics technologies are active on our Site, information that you viewed or purchased a health-related product may be shared with Google, Microsoft, Meta, Pinterest, and OpenAI for advertising and measurement purposes. Some state laws treat this kind of sharing as a “sale” even though we receive no money for it. You can stop this sharing using the controls in Section 8.

7. Your Rights

If you are a Washington or Nevada resident, you have the right to:

  • Confirm whether we are collecting, sharing, or selling your consumer health data.
  • Access your consumer health data, including a list of all third parties and affiliates with whom we have shared it, and contact information for each.
  • Withdraw your consent to our collection and sharing of your consumer health data.
  • Delete your consumer health data. If you request deletion, we will delete it from our records and notify the service providers and third parties listed above to do the same. Some information may be retained where the law requires it, such as records of completed transactions kept for tax purposes.
  • Appeal a decision if we decline your request.

We will not deny you products, charge you a different price, or provide a lower quality of service because you exercised these rights.

8. How to Exercise Your Rights

Email support@reposepoint.com with the subject line “Consumer Health Data Request,” or call +1 (307) 218-7893. Please tell us which right you are exercising and include the email address and any order number associated with your purchases so we can locate your records.

We will respond within 45 days. If we need more time, we will notify you within that period and may extend by an additional 45 days. There is no charge.

To withdraw consent to advertising and analytics sharing: email us with the subject line “Withdraw Consent,” and we will suppress your profile from our marketing and analytics tools. You may also use the platform opt-out controls listed in our Privacy Policy.

Appeals: if we decline a request, you may appeal by replying with the subject line “Consumer Health Data Appeal.” We will respond within 45 days with a written explanation. If your appeal is denied, Washington residents may submit a complaint to the Washington State Attorney General at atg.wa.gov/file-complaint.

9. How Long We Keep It

Consumer health data contained in order records is retained for seven years to meet tax and accounting obligations. Browsing and analytics data is retained according to each provider’s retention window, generally 30 days to 14 months. Customer support correspondence is retained for three years. Marketing profile data is retained until you unsubscribe or withdraw consent.
